The RTBU recently raised concerns with V/Line around access to break entitlements. Members and delegates in the South West region in stations and conductor grades have reported that there are certain circumstances or instances when they are unable to take either an unpaid break or a paid 20-minute crib in lieu.
This raised an important question: when operational demands prevent an employee from taking their entitled break, what is the appropriate form of compensation for the loss of that entitlement?
Some members had been claiming a ‘wasted meal’ allowance on their timesheet as had been common practice for many years. However, in some instances these claims were now being removed from timesheets by local management without any discussion.
We raised this matter directly with V/Line. We can now report that V/Line has confirmed that:
- When an unpaid break or a paid break cannot be taken, a wasted meal allowance should be paid.
- Timesheets should not be changed without prior discussion with an employee.
What happens next?
The RTBU has now formally written to V/Line on behalf of affected members. We are compiling records of shifts where claimed allowances were removed and will be seeking back pay for those members. We are also seeking that V/Line ensures managers receive clear direction and stop this practice of altering claimed allowances.
While these concerns originated in the South West, we cannot be certain that it is not more widespread.
